Terms of Use
Welcome to Retire Well Canada. These Terms of Use (the “Terms”) govern your access to and use of the websites, landing pages, online forms, downloadable materials, telephone enquiry lines, and related digital services operated under the Retire Well Canada name (collectively, the “Site” or “Services”).
By accessing or using the Site, requesting materials, submitting an enquiry, or otherwise interacting with Retire Well Canada online or by telephone in connection with the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy & Cookie Policy. If you do not agree, you must not use the Site or Services.
1. About Retire Well Canada
Retire Well Canada provides educational information and marketing materials relating to retirement planning, investing concepts, and related financial topics for residents of Canada. References in these Terms to “Retire Well Canada,” “we,” “us,” or “our” mean the operator of this Site and, where applicable, its affiliated entities involved in operating or supporting the Site.
Fisher Asset Management, LLC does business under this name in Ontario and Newfoundland & Labrador. In all other provinces, Fisher Asset Management, LLC (FAM) does business as Fisher Investments. Nothing on the Site creates a client relationship with Fisher Asset Management, LLC, Fisher Investments, or any affiliated advisory firm unless and until you enter into a separate written agreement with that firm.
The Site is intended for general information and educational purposes. Content may describe concepts, strategies, historical observations, or illustrative examples. It is not tailored to your personal financial circumstances unless expressly stated in a separate engagement.
2. Acceptance of These Terms
These Terms form a legally binding agreement between you and Retire Well Canada. You accept these Terms by:
- browsing, accessing, or using any part of the Site;
- requesting, downloading, or receiving guides, reports, newsletters, or other materials;
- submitting contact details, enquiry forms, or other information through the Site;
- contacting us by telephone, email, or other channels referenced on the Site; or
- continuing to use the Site after we post an updated version of these Terms.
If you use the Site on behalf of another person or organisation, you represent that you have authority to bind that person or organisation to these Terms, and “you” includes that person or organisation.
3. Eligibility and Geographic Scope
The Site is directed primarily to individuals who are residents of Canada and who are of legal age in their province or territory of residence to enter into a binding contract. By using the Site, you represent that you meet these requirements.
We do not represent that the Site or any materials available through it are appropriate or available for use in every location. If you access the Site from outside Canada, you do so on your own initiative and are responsible for compliance with local laws. Certain products, services, or communications may be unavailable, restricted, or unsuitable outside specific Canadian jurisdictions.
You may not use the Site if you are prohibited from receiving products, services, or communications under applicable law, or if we have previously suspended or terminated your access.

We may modify, suspend, or discontinue any part of the Site or Services at any time, with or without notice, including for maintenance, legal compliance, security, or business reasons. We are not obligated to provide any particular feature indefinitely.
5. Educational Content Only — No Personal Advice
Unless you have entered into a separate written advisory or other professional agreement, nothing on the Site constitutes:
- personalised investment, tax, legal, accounting, or financial advice;
- a recommendation to buy, sell, or hold any security or investment product;
- an offer or solicitation to provide investment advisory services;
- a guarantee of any investment result, income level, or retirement outcome; or
- a statement that any strategy is suitable for your specific circumstances.
Investing in stock markets involves the risk of loss, and there is no guarantee that all or any capital invested will be repaid. Past performance is no guarantee of future returns. The value of investments and the income from them will fluctuate with world financial markets and international currency exchange rates.

6. Advertorial and Marketing Nature of Certain Pages
Certain pages on the Site may be labelled “Advertorial” or otherwise presented as sponsored or promotional content. Such pages are designed to provide educational information while also promoting Retire Well Canada’s materials, contact opportunities, or related services. The presence of educational content does not change the marketing nature of those pages or convert them into impartial news reporting.
Headlines, imagery, testimonials (if any), statistics, and case-style examples may be illustrative. Where performance figures, historical ranges, or survey results appear, they are provided for context only and should not be interpreted as a prediction of your results.
7. Requests for Guides, Materials, and Contact
If you request a guide, report, newsletter, or other material, or ask to be contacted, you agree to provide accurate, current, and complete information. You authorise Retire Well Canada and its service providers to use the contact details you supply to:
- deliver the requested materials;
- respond to your enquiry by email, telephone, SMS/text (where permitted), or postal mail;
- discuss whether Retire Well Canada or an affiliated advisory service may be a fit for you; and
- send related educational or marketing communications where permitted by law and our Privacy & Cookie Policy.
Submitting a form or requesting materials does not obligate you to become a client, purchase a product, or continue communications. You may withdraw consent or unsubscribe as described in our Privacy & Cookie Policy and applicable marketing laws, including Canada’s Anti-Spam Legislation (CASL) where it applies.
We may decline, delay, or limit fulfilment of a request if information appears incomplete, inaccurate, fraudulent, or outside our service area, or if we believe fulfilment would violate law or these Terms.
8. Telephone Communications and Call Recording
If you call or are contacted at a number associated with the Site, you acknowledge that calls may be monitored or recorded for quality assurance, training, compliance, and record-keeping purposes, to the extent permitted by applicable law. - misrepresent your identity, affiliation, or the origin of any information you submit;
- harvest or collect personal information of other users without consent; or
- use the Site to send unsolicited commercial electronic messages or to promote products or services unrelated to a bona fide enquiry with us.
We reserve the right to investigate suspected violations and to take appropriate action, including suspending access, reporting to law enforcement, and pursuing civil remedies.
10. Intellectual Property
The Site and its contents — including text, graphics, logos, icons, images, audio clips, video, downloadable files, software, page layout, and compilation — are owned by Retire Well Canada, its licensors, or other providers and are protected by Canadian and international copyright, trademark, and other intellectual property laws.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Site for your personal, non-commercial informational purposes, and to download or print a reasonable number of copies of materials expressly offered for download, solely for your own use, provided you retain all proprietary notices.
You may not use “Retire Well Canada,” related logos, or other marks without our prior written permission, except for nominative fair use referencing our name in a factual manner that does not suggest endorsement. All rights not expressly granted are reserved.
11. User Submissions
If you submit comments, feedback, questions, ideas, or other content to us through the Site or related channels (“Submissions”), you grant Retire Well Canada a worldwide, royalty-free, perpetual, irrevocable, non-exclusive licence to use, reproduce, modify, adapt, publish, translate, distribute, and display such Submissions for operating, improving, and promoting the Site and Services, and for other lawful business purposes, without compensation to you, to the extent permitted by law.
You represent that your Submissions do not infringe any third-party rights and do not contain unlawful, defamatory, or confidential information you are not authorised to disclose. We have no obligation to keep Submissions confidential unless we expressly agree in writing or unless required by our Privacy & Cookie Policy or applicable law.
12. Third-Party Websites, Tools, and Services
The Site may contain links to third-party websites, platforms, tools, or services that we do not own or control, including social media platforms and analytics or advertising partners. We provide these links for convenience only. We do not endorse, and are not responsible for, the content, accuracy, privacy practices, security, or availability of third-party sites.
Your use of third-party sites is governed by their own terms and privacy policies. We encourage you to review those documents before providing personal information or relying on third-party content.

14. Accuracy of Information and Updates
We endeavour to keep Site content reasonably accurate and current, but we do not warrant that all information is complete, error-free, or up to date at all times. Tax rules, investment products, market conditions, regulatory requirements, and contact details can change. Content may become outdated after publication.
We may correct errors or update content without prior notice. The presence of a “Last Updated” date on a page indicates when that page was last revised, but does not guarantee that every statement reflects the most recent legal or market developments.
15. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL CONTENT, MATERIALS, AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Without limiting the foregoing, we do not warrant that:
- the Site will be uninterrupted, secure, or free of errors or viruses;
- results obtained from use of the Site will be accurate or reliable;
- any defects will be corrected; or
- the Site or servers that make it available are free of harmful components.
Some jurisdictions do not allow the exclusion of certain warranties. In such jurisdictions, some of the above exclusions may not apply to you to the extent prohibited by law.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL RETIRE WELL CANADA, ITS AFFILIATES, OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR RELIANCE ON ANY CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE WILL NOT EXCEED ONE HUNDRED CANADIAN DOLLARS (CAD $100) OR THE AMOUNT YOU PAID US (IF ANY) FOR ACCESS TO THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence where such exclusion is prohibited.
17. Indemnification
You agree to defend, indemnify, and hold harmless Retire Well Canada, its affiliates, and their respective directors, officers, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- your use of the Site or Services;
- your violation of these Terms;
- your violation of any law or third-party right; or
- any Submission you provide.
We reserve the right, at our own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defence of such claim.
18. Suspension and Termination
We may suspend or terminate your access to all or part of the Site at any time, with or without notice, if we reasonably believe you have violated these Terms, created risk or possible legal exposure for us, or if continued access would be unlawful or impractical.
Upon termination, the licence granted to you under these Terms ends immediately. Sections that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute provisions — will survive termination.
19. Changes to These Terms
Retire Well Canada may revise these Terms from time to time. We will post the revised Terms on this page at https://retirewellcanada.com/terms.html and update the “Last Updated” date. Additional notice will be provided if and as required by applicable law.
Changes become effective when posted, unless the revised Terms state otherwise. By continuing to use the Site after changes become effective, you accept the revised Terms. If you do not agree, you must stop using the Site. It is your responsibility to review these Terms periodically.
20. Governing Law and Disputes
These Terms and any dispute arising out of or relating to these Terms or the Site will be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles, except where mandatory consumer protection laws of your province or territory of residence require otherwise.
Subject to those mandatory protections, you and Retire Well Canada agree that the courts of the Province of Ontario will have exclusive jurisdiction over disputes arising from these Terms or the Site, and you consent to personal jurisdiction in those courts. Nothing prevents either party from seeking interim or injunctive relief in any court of competent jurisdiction to protect intellectual property or confidential information.
Before commencing formal proceedings, you agree to contact us first using the details in the Contact Us section below and to attempt in good faith to resolve the dispute informally within thirty (30) days.
21. Export and Sanctions Compliance
You may not use, export, or re-export any part of the Site or related materials except in compliance with Canadian, U.S., and other applicable export control and sanctions laws. You represent that you are not located in a country or region subject to comprehensive embargoes and are not a person prohibited from receiving such materials under applicable law.
22. Electronic Communications
By using the Site or providing your email address or phone number, you consent to receive electronic communications from us related to your use of the Site, fulfilment of requests, and (where permitted) marketing. You agree that electronic notices, disclosures, and agreements satisfy any legal requirement that such communications be in writing, to the extent permitted by law.
23. Severability, Waiver, and Assignment
If any provision of these Terms is held invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed. The remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative to be effective.
You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms without restriction. These Terms bind and benefit the parties and their permitted successors and assigns.
24. Entire Agreement
These Terms, together with the Privacy & Cookie Policy and any other legal notices or additional terms posted on specific pages of the Site, constitute the entire agreement between you and Retire Well Canada regarding the Site and supersede prior or contemporaneous understandings relating to your use of the Site. If there is a conflict between these Terms and additional terms posted for a specific feature, the additional terms will control for that feature.
These Terms do not create a partnership, joint venture, employment, or agency relationship between you and Retire Well Canada. There are no third-party beneficiaries to these Terms except as expressly stated for indemnified parties.
25. Language
The parties have requested that these Terms and all related documents be drawn up in English. If we provide a translation, the English version controls to the extent permitted by law, except where mandatory local law requires otherwise.
